09.06.2008 - Altner's billion-crown claim without chance to succeed-Czech CSSD

He said he wants to present information that would correct what he called myths and errors accompanying the CSSD-Altner dispute. According to Havlicek, Altner did not "win" the Lidovy dum headquarters for the CSSD as he started to represent the party only in 1997, after the CSSD's ownership of Lidovy dum was confirmed. Altner's task was only to secure the entry of the new members of the statutory bodies of the Cil company, Lidovy dum's official owner controlled by the Czech opposition CSSD expects no-confidence in three weeks ...

CSSD, in the Register of Companies, Havlicek said. He said the CSSD had paid 50.4 million crowns to Altner in accordance with the then contract.

Altner took over one-third of the sum directly, the remaining 33 million were deposited in judicial custody from where no one has drawn it. Altner was not the only defence lawyer entrusted with the Cil members' registration, there were another two layers working on it. The contract did not specify how they should divide the remuneration among themselves, the CSSD put the money in judicial custody, thereby fulfilling its commitment from its contract with Altner, Havlicek said. In a long-lasting court dispute Altner wants the CSSD to pay almost 20 billion crowns (remuneration worth 93 million plus penalty fees) to him for representing the party in the Lidovy dum dispute. Some time ago he proposed that bankruptcy proceedings be launched against the CSSD, but the High Court in Prague definitely rejected his claim this February. Altner's counsel then did not rule out they might request an appellate review at the Supreme Court. Havlicek said Altner's claims exceeding his 50-million-crown remuneration are disputable. The remuneration of 50.4 million crowns alone evidently goes far above the work Altner had done for the party, Havlicek said. Lidovy dum in the centre of Prague was the CSSD's headquarters from 1907. After the February 1948 communist coup it was taken over by the Communists. After the 1989 fall of the regime the CSSD claimed the building. The CSSD vs state court dispute, that started in 1993, definitively ended in January 2000 when the Constitutional Court confirmed the CSSD's status as the successor of the pre-1948 CSSD.
